Administrative and legal opposition to bullying, as well as research into types of violence that are not foreseen by law

Abstract

The content of this publication analyses the theoretical and practical aspects of such a phenomenon as bullying. In connection with this, derivative units were discovered, which are cyber-bullying and mobbing, and which combine other types of violence in view of their environment. A brief description of the characteristics of each of the types of violence studied is presented. An analysis was made of Ukrainian legislation on counteracting liability for the crime committed, which is contained in the laws governing the educational environment, including the relations between students, as well as the administrative component that makes it possible to recognize the crime and bring to justice. Attention was drawn to the existence of anti-abuse mechanisms and the need for administrative responses to violence in adult groups (student and work environments) and on the Internet, following which changes were proposed. Key mechanisms for the detection and prevention of various forms of violence, taking into account European practice, have been identified. The necessity to separate the definitions of mobbing and cyber-bullying as independent crimes taking into account the subjective composition and setting of the object, special characteristics, signs of identification and the creation of a response taking into account the specific environment for the emergence of aggressive behavior is brought. In addition, it has been established a clear link between the administrative responsibility for bullying and cyberbullying and the effectiveness of measures of administrative attraction from the standpoint of preventive measures and as a tool to educate the offender of a firm understanding of the danger and punishment for what he did, as well as such norms that legally prevent repeated violations and create conditions for the impossibility of causing fatal losses.
