ТЕНДЕНЦІЇ РОЗВИТКУ ПРАВА ІНТЕЛЕКТУАЛЬНОЇ ВЛАСНОСТІ УКРАЇНИ В КОНТЕКСТІ УГОДИ ПРО АСОЦІАЦІЮ
Abstract
Boyko I. Y. Trends in the development of intellectual property law of Ukraine in the context of the Association Agreement. – Article. The article is devoted to the study of key trends in the development of intellectual property law of Ukraine through the prism of the Association Agreement. The main achievements of Ukraine on the path to European integration in the context of the reform of intellectual property law in Ukraine, launched in 2016, are highlighted. Emphasis is placed on the fact that the purpose of this reform was not only the adoption of updated special legislation, but also the implementation of deep institutional changes. It is noted that the foundations of the reform of intellectual property law were laid in the Concept of Reforming of the State System of Intellectual Property Legal Protection in Ukraine. The importance of adopting the National Strategy for the Development of Intellectual Property in Ukraine for the period 2020–2025 is noted. One of the key ideas of the Strategy is the need to introduce the commercialization of intellectual property in the state policy and its effective integration into the national economy. It is emphasized that an important step towards the implementation of the standards set by the Association Agreement is the judicial reform in the field of protection of intellectual property rights in Ukraine. The key aspects of the legal status of the Supreme Court on intellectual property issues are analyzed. It is noted that today the intellectual property law of Ukraine is at the stage of active reform. Prospects for improving the system of legal protection of intellectual property in Ukraine are outlined. The expediency of implementing into national legislation the provisions of a number of directives of the European Union in the field of protection of intellectual property rights is substantiated. Attention is drawn to the importance of improving the existing mechanisms for the protection of intellectual property rights in the digital network and the introduction of a new model of the relationship between creators and the media, the publishing business.
